Terms of Use

These Terms of Use ("Terms") govern your access to and use of Impact Athlete, operated by Todd Durkin Enterprises ("Todd Durkin Enterprises", "we", "us"), including our website, the Impact Athlete membership, emails we send you, live sessions, and any related services (together, the "Services"). By checking the consent boxes at sign-up, creating an account, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who may use Impact Athlete — age requirements

Impact Athlete is built for youth, high school and collegiate athletes and the parents or guardians who support their development. You must be at least 18 years old to create an account and agree to these Terms.

• A parent or legal guardian must create and control the account for any athlete under 18, and is responsible for that athlete's use of the Services and for the information submitted about them.
• Children under 13. We do not knowingly permit anyone under 13 to create an account or use the Services on their own. Information about an athlete under 13 may only be submitted by their parent or legal guardian, who gives consent at sign-up and when entering the athlete's details. If we learn a child under 13 created an account without a parent or guardian, we will delete that account and its data. See the Privacy Policy for how a parent reviews, corrects, exports, or deletes their child's information, or withdraws consent.
• By adding an athlete's information, you confirm you are that athlete's parent or legal guardian, or that you have their guardian's permission, and you consent to our processing of that information as described in our Privacy Policy.
• You may not use the Services if we have previously suspended or removed your access.

2. Your account and consent record

Keep your login credentials confidential and make sure the information in your account is accurate. You are responsible for everything that happens under your account. We record the date, time and version of the Terms and Privacy Policy you accepted at sign-up. Contact us if you believe your account has been compromised.

3. Membership, billing, promotion codes and cancellation

• Membership is billed in advance at the price shown at checkout (currently $40 per month, billed annually at $480, or $49 per month billed every 6 months at $294) and renews automatically at the end of each billing period until cancelled.
• Payments are processed by our payment processor, Stripe. We do not store your full card details. Taxes may be added where required.
• Promotion and founder codes may be applied at checkout and reduce the price as stated when the code was issued.
• You may cancel at any time from your billing settings. Cancellation stops future renewals; your access continues through the end of the paid period. Except where required by law, payments already made are non-refundable, and we do not provide partial-period refunds.

4. Member content and acceptable use

• Membership content — including the Impact Athlete course, Pro Athlete Protocols, Weekly Mindset Drops, the Mindset Journal, live Q&A sessions, Athlete Summits and Parent Circle resources — is for your personal, non-commercial use and the use of athletes registered under your account.
• You may not share your account, copy, redistribute, resell, or publicly post member content, session recordings, or access links.
• You may not misuse the Services, attempt to access another member's information, or interfere with the operation of the Services.

5. Coaching Network

The Coaching Network matches athletes and families with independent coaches in Todd Durkin's certified network. Any 1-on-1 coaching arrangement is solely between you and the coach. Todd Durkin Enterprises is not a party to that arrangement and is not responsible for the coach's services, scheduling, pricing, or conduct.

6. Not medical or mental-health advice

Impact Athlete provides mindset and performance education. The Services are not medical, psychological, or mental-health advice, diagnosis, or treatment, and are not a substitute for professional care. If an athlete is struggling with their mental health, please seek a qualified professional. In an emergency, call or text 988 (Suicide & Crisis Lifeline) or your local emergency number.

7. Team and school fundraising

When a member joins with a valid team or school code, 25% of eligible subscription revenue is credited to that team's fundraising ledger, as described on the fundraising page. Payouts to teams and schools are made according to program rules and may require the organization to provide payment and tax information. We may adjust or end the fundraising program prospectively with notice.

8. Charitable pledge

10% of profits go to the Durkin IMPACT Foundation, a 501(c)(3) nonprofit. This pledge describes our company's giving; your membership payment is not a tax-deductible charitable contribution.

9. Intellectual property

The Services and all content, branding, and materials are owned by Todd Durkin Enterprises or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access member content for personal use while your membership is active.

10. Termination

You may cancel and stop using the Services at any time. We may suspend or terminate access for violation of these Terms, non-payment, or misuse. Sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) survive termination.

11. Disclaimers and limitation of liability

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Todd Durkin Enterprises will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us in the twelve months before the claim.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify members by email or in the Member Dashboard and update the version recorded at your next sign-in or renewal. Continued use after changes take effect means you accept the updated Terms.
